Given that the agencies plan is to let these rules expire pursuant to G.S. 150B-21.3A(b), and then adopt the rules as new, the formal review of reports process will not be necessary. Only rules that were in the Code as of January 1, 2024, are required to go through the review process during the 2024-2034 process.

In accordance with G.S. 150B-21.3A(c)(1), and as part of the Council of State's ongoing efforts to comply with the Periodic Review of Rules process, we are submitting the agency's initial determinations regarding the necessity of the subject rules.
We acknowledge that these rules are scheduled to expire on November 1, 2025, and that this expiration date precedes the conclusion of the public comment period. While we recognize the delay in initiating this process, we are making every effort to adhere to the requirements of the rules review process to the fullest extent possible under the circumstances. This submission reflects the direction of the Council of State, which has chosen to move forward with soliciting feedback on the necessity of these rules.
In anticipation of the rules' expiration, the agency is also preparing to initiate rulemaking to ensure their timely return to the Administrative Code.

Alex forwarded me your email of Tuesday, September 16, 2025. You’ve asked for Julie Ventaloro to be added to the rulemaking coordinators’ distribution list and to copy her on communications with OSBM on OSBM or Council of State rules. Ms. Ventaloro is already on the rulemaking coordinators’ distribution listserv, although she has not been designated as the rulemaking coordinator for either Council of State or OSBM. Thus, she should already have received any communications directed to the rulemaking coordinators’ distribution listserv. In that light, are you requesting that Ms. Ventaloro be added as a rulemaking coordinator for both OSBM and Council of State? If so, I will need that designation in writing from the Governor. The designation must contain the rulemaking coordinator’s name and contact information (mailing address, email address, and phone number).
As to your request for our staff to copy Ms. Ventaloro on any communications related to OSBM or Council of State rules, we must kindly demur. Our staff is not responsible for ensuring that our communications reach anyone beyond the agency’s designated rulemaking coordinator. See G.S. 150B-21(a) (the rulemaking coordinator is the agency’s liaison between other agencies in the rulemaking process). Given the volume of communications we handle every day, I cannot ask my staff to remember to copy someone not on the rulemaking coordinator list for a particular agency or agencies.

Your understanding is incorrect. The RRC will meet on September 25 and October 30. Alex has made it abundantly clear in the series of emails you have been sent that the filing deadline is September 20, 2025.
If not already completed, the following steps must be taken before filing your periodic review report(s):
- The rulemaking body, the Board, Commission, or agency head, must make initial determinations
- G.S. 150B-21.3A(c)(1) requires the agency to file the report on its and OAH websites for 60 days and accept public comments.
- At the close of the 60-day comment period, the Board, Commission, or agency head must review all comments received, prepare a response for each public comment to put in the report, and make a final determination for each rule.
- File the Excel report with initial designations and the accompanying form to [email protected]

According to my records, the initial designation reports for 06 NCAC 01, 02, and 04 have not been filed. Additionally, the final report deadline for the September RRC review is August 20th. As the initial reports remain outstanding and have not been posted to your agency’s website, the required review has not been completed.
If your agency intends to retain these rules, a waiver for an extension must be requested from the Rules Review Commission at the September meeting. If the intention is to allow these rules to expire and be removed from the Administrative Code, please let me know.
I’ve copied staff counsel on this message, should you have any questions about the waiver process.

- At the close of the 60-day comment period, the Board, Commission, or agency head must review all comments received, prepare a response for each public comment to put in the report, and make a final determination for each rule.
- File the Excel report with initial designations and the accompanying form to [email protected]
If your agency does not complete the process and submits a final report by September 20, 2025, all rules in the report will automatically expire at the meeting the following month. The agency’s rules will be removed from the North Carolina Administrative Code. Further, G.S. 150B-21.3A requires the Rules Review Commission to report all rules that expired to the General Assembly’s Joint Legislative Administrative Procedure Oversight Committee.

By statute, the State Budget Director is Secretary to the Council of State so I think it makes sense for OSBM’s rulemaking coordinator, Loretta Peace-Bunch, to be the rulemaking coordinator for COS. When John Maddrey was working at DOA, he had a dedicated share of time for OSBM which must be how he became the COS coordinator.

Good morning, Scarlett and Loretta,
I’m reaching out to both of you as the Rulemaking Coordinators for the Governor’s office and OSBM, which I understand houses staff to the Governor. The Rules Division needs a current Rulemaking Coordinator for the Council of State so we can send the reports for the Periodic Review process as required by G.S. 150B-21.3A. To name a coordinator, the head of the agency needs to designate one in writing or the Council can name one in its meeting minutes. Please send a copy of the designation directly to me.
The Council of State’s named Rulemaking Coordinator is still John Maddrey. John retired some time ago. Since that time, we have not received an updated designation from the Council of State.
If there is someone else I need to reach out to or if you have any questions, please let me know.
