1. Yes, an email does suffice. Please see an attached example timeline.
2. Yes, your attached Draft does comply with the requirements, however, I have a couple of questions.
Does the column, “Commission Approval for Filing” indicate the timeframe for “readoption” by your agency?
Are you able to provide a more precise timeframe as to when each step may take place? I understand it’s difficult to narrow down the timeframe for each step in the process this far in advance, but please try to predict within a few months when each step will take place.
3. No, there is not a template that should accompany the information provided.
The timeline can be projections of when certain actions will be taken by your Board or agency. Please be as specific as possible with dates, but I realize circumstances may change and unforeseeable events may arise. Please communicate to me any unexpected changes when they occur.
There are several factors your agency should consider when setting the readoption deadline. Please be mindful of 26 NCAC 05.0212(c)(2) that requires agencies to file rules with the RRC within 30 days of adoption. Remember to consider whether your agency will need to prepare any fiscal notes as required by G.S. 150B-21.4. Also, please account for whether your agency will want to amend any rules after the public comment period and rulemaking hearing that may constitute s substantial change under 150B-21.2(g).

Since I never have filed a Periodic Review Report, I am seeking guidance from you to ensure that we comply with all requirements. I have read the rule below and have the following questions.
1. Does an email suffice as the written documentation of the agency’s planned timeline for adoption? We agree with the suggested December 1, 2028 readoption deadline.
2. Does the DRAFT attachment comply with the documentation required for the planned dates for all steps? Or is there a prepared format that the RRC requires?
3. Is there a template (such as form 300 or 400) that must accompany the attachment?

26 NCAC 05 .0212 READOPTIONS
(a) When setting a readoption deadline pursuant to G.S. 150B-21.3A(d)(2), an agency that is not a board or commission shall, within 60 days of receipt of the Commission's consultation request, submit to the Commission:
(1) written documentation of the agency's planned timeline for readoption, providing planned dates for all steps required by G.S. 150B-21.2; and
(2) written documentation of any of the agency's rulemaking priorities that the agency determines to be relevant to the timeline for readoption.
(b) A board or commission shall take the actions specified in Subparagraphs (a)(1) and (a)(2) of this Rule within 60 days of receipt of the Commission's consultation request, or within 10 days after the board or commission's next regularly scheduled meeting after receipt of the Commission's consultation request, whichever comes later.
(c) To meet the readoption deadline established pursuant to G.S. 150B-21.3A(d)(2) and Paragraphs (a) or (b) of this Rule, an agency, board, or commission shall:
(1) adopt the rule, as defined in G.S. 150B-2(1a), by the date established pursuant to G.S. 150B-21.3A(d)(2) and Paragraph (a) or (b) of this Rule; and
(2) file the rule with the Commission within 30 days of adoption.

I am seeking your guidance regarding the rules listed for the Sheriffs’ Commission’s periodic review. We agree with the readoption deadline of December 1, 2028.
I have been working on my draft of the Periodic Rules Review timeline and noticed a few anomalies. Two rules .0405 and .0411 have been erroneously omitted from our list and they are still necessary rules. Rule .1003 (Basic LEO Certificate) has been repealed and should not be included on this list.
Please let me know if there are additional steps I need to take to address this matter.

The attached periodic review report has been finalized. The next step is to set a deadline for the readoption of the “Necessary” rules. Pursuant to G.S. 150B-21.3A and 26 NCAC 05 .0212, the RRC sets this deadline after
consultation with the agency, and this email serves as the RRC’s request for that consultation. Please review 26 NCAC 05 .0212 for the information required to be submitted to the RRC, and the deadlines for doing so.
The deadline for your agency to provide this information is November 12, 2025. As a starting point, I would recommend a readoption deadline of December 1, 2028, but I am open to considering a different recommendation based on the needs of your agency.
