26 NCAC 05.0212 (a)(1) and (a)(2) DOES apply to you through (b), as you wrote below (“shall take the actions specified in Subparagraphs (a)(1) and (a)(2) of this Rule”).

No, your email does not satisfy the requirements in (a)(1) and (b)(2). Your agency must submit the information required just like every other agency subject to 150B-21.3A.

I’ve attached an example that another agency submitted to comply. Let me know if you have any further questions.

To confirm, the NCRCB accepts the February 2029 readoption date recommended. So I am clear, 26 NCAC 05 .0212 (a) does not apply to us.

However, 26 NCAC 05 .0212 (b) does apply.

A board or commission shall take the actions specified in Subparagraphs (a)(1) and (a)(2) of this Rule within 60 days of receipt of the Commission's consultation request, or within 10 days after the board or commission's next regularly scheduled meeting after receipt of the Commission's consultation request, whichever comes later.

Does this notification satisfy this requirement? Let me know when to expect the next steps.

The attached periodic review report has been finalized. The next step is to set a deadline for the readoption of the “Necessary” rules. Pursuant to G.S. 150B-21.3A and 26 NCAC 05 .0212, the RRC sets this deadline after consultation with the agency, and this email serves as the RRC’s request for that consultation. Please review 26 NCAC 05 .0212 for the information required to be submitted to the RRC, and the deadlines for doing so.

The deadline for your agency to provide this information is November 12, 2025. As a starting point, I would recommend a readoption deadline of February 1, 2029, but I am open to considering a different recommendation based on the needs of your agency.
