The following is submitted as required to Mr. Travis Wiggs, for rules under the Cemetery Commission, whose periodic review reports were approved by the Rules Review Commission at the August 2025 meeting.
This timeline is a proposed readoption schedule for the above-mentioned rules. The dates noted on the timeline refer to a deadline, and not a specific date, as the meeting dates for the Cemetery Commission for 2027 and 2028 have not yet been established. The timeline is based on previous meeting dates typical of the Cemetery Commission’s schedule.

Please review 26 NCAC 05 .0212 for the information required to be submitted to the RRC. The Rule essentially requires every agency to submit a general timeline of when your agency intends to complete each step in the permanent rulemaking process. Most agencies have done the consultation via email but I’m happy to have a call to discuss further.
There are several factors your agency should consider when setting the readoption deadline. Please be mindful of 26 NCAC 05.0212(c)(2) that requires agencies to file rules with the RRC within 30 days of adoption. Remember to consider whether your agency will need to prepare any fiscal notes as required by G.S. 150B-21.4. Also, please account for whether your agency will want to amend any rules after the public comment period and rulemaking hearing that may constitute s substantial change under 150B-21.2(g).
Please see an attached example timeline and submit the required information to me by 5pm on November 12, 2025 (as requested in the email below). Please let me know if you have any questions or concerns.

Pursuant to G.S. 150B-21.3A and 26 NCAC 05 .0212, the RRC sets this deadline after consultation with the agency, and this email serves as the RRC’s request for that consultation. Please review 26 NCAC 05 .0212 for the information required to be submitted to the RRC, and the deadlines for doing so.
The deadline for your agency to provide this information is November 12, 2025. As a starting point, I would recommend a readoption deadline of September 1, 2028, but I am open to considering a different recommendation based on the needs of your agency.

The deadline to provide the consultation information is November 12, 2025, pursuant to below:
26 NCAC 05 .0212 READOPTIONS (a) When setting a readoption deadline pursuant to G.S. 150B-21.3A(d)(2), an agency that is not a board or commission shall, within 60 days of receipt of the Commission's consultation request, submit to the Commission: (1) written documentation of the agency's planned timeline for readoption, providing planned dates for all steps required by G.S. 150B-21.2; and (2) written documentation of any of the agency's rulemaking priorities that the agency determines to be relevant to the timeline for readoption. (b) A board or commission shall take the actions specified in Subparagraphs (a)(1) and (a)(2) of this Rule within 60 days of receipt of the Commission's consultation request, or within 10 days after the board or commission's next regularly scheduled meeting after receipt of the Commission's consultation request, whichever comes later. (c) To meet the readoption deadline established pursuant to G.S. 150B-21.3A(d)(2) and Paragraphs (a) or (b) of this Rule, an agency, board, or commission shall: (1) adopt the rule, as defined in G.S. 150B-2(1a), by the date established pursuant to G.S. 150B21.3A(d)(2) and Paragraph (a) or (b) of this Rule; and (2) file the rule with the Commission within 30 days of adoption
You can obviously submit the information prior to the deadline if you so choose.
