We would like to stick with what the CRC approved. Since they meet in mid-April, for administrative purposes, can the readopt date just be May 1, 2026? I understand the RRC has authority over this and if you want to make that date June 1, 2026, that works for us.

Yes, it’s okay if the CRC adopts the rules at its April meeting. I was just offering to give the CRC two more months in case an unexpected obstacle arises. Do you want to set the deadline for April 1, 2026 since its already been approved?
We can’t prevent agencies from submitting rules to the RRC prior to their readoption deadline. However, the submitted rules may not be voted on by the RRC before the agreed upon readoption deadline. This will depend on the number of rules that are scheduled to be reviewed for that particular month.

I’m satisfied with the proposed readoption timeline submitted by your agency. I sent a recommended readoption deadline of December 1, 2027 (email sent 9/11/25). I’m happy to set the deadline sooner, but please confirm the date you’re requesting. Can we agree the readoption deadline for your agency will be June 1, 2026?
The RRC will plan to vote on the agreed readoption deadline of June 1, 2026 at its next meeting on December 18, 2025 at 10am.

Got it, let me bounce this off our folks. Since the April date was voted on and approved, I’m guessing we’ll need to stick to that. But I will double check with counsel and staff.
Also, June is potentially a tricky month for the CRC and the DEQ Division of Coastal Resources staff in the event of potential hurricane impacts. If we stick to April, it will not be the 1st as you stated below because the CRC is set to meet on April 15 & 16. I can specify that in the schedule below. Will be in touch.

The attached periodic review report has been finalized. The next step is to set a deadline for the readoption of the “Necessary” rules. Pursuant to G.S. 150B-21.3A and 26 NCAC 05 .0212, the RRC sets this deadline after consultation with the agency, and this email serves as the RRC’s request for that consultation. Please review 26 NCAC 05 .0212 for the information required to be submitted to the RRC, and the deadlines for doing so.
The deadline for your agency to provide this information is November 12, 2025. As a starting point, I would recommend a readoption deadline of December 1, 2027, but I am open to considering a different recommendation based on the needs of your agency.
