I was going to email you all regarding our issue. This is probably more for Brian.

When I'm on the 'review of rules' page, all the other agencies show rules entries except for us when you click on them. Below is an example of 'Well contactor certification rules" and 'Services for deaf and hard of hearing".

Can you provide a contact who can assist with getting the actual rules to show for 'Deaf and hard of Hearing'? It appears the links are correct but for whatever reason, our rules don't show like the other ones where you can select and add a comment. I don't know who's responsible for entering that on the rules site.

Periodic Review of Rules

Pursuant to G.S. 150B-21.3A, Periodic Review and Expiration of Existing Rules, the Division of Services for NCAC 17 of the North Carolina Administrative Code for public comment.

G.S. 150B-21.3A(a)(5) defines "public comment" as a written objection to all or part of a rule or the agency's the agency determined to be unnecessary, the Rules Review Commission shall determine whether it has me Review Commission to determine whether the public comment has merit, the public comment must address review, as set forth in G.S. 150B-21.9(a). An unnecessary rule is defined as a rule that the agency determine other than an unnecessary rule.

Hi Ms. Jones,

I'm sorry to hear you're having trouble. However, I'm not sure what's wrong with your posting. This doesn't seem to be a link to the OAH website or anything that I would have control over. I think you need to talk to your internal staff and see why the report isn't where it's supposed to be.

If this has been posted in this way since September 5, with the public unable to view your report, it appears to me you'd need to re-start your comment period in order to give the public the full 60 days to comment.

As a reminder, your report is due to be reviewed at the December 2025 RRC meeting, and the filing deadline for that meeting is November 20. If you think you won't be able to make your deadline, you can request an extension of the time for review from RRC. You'll want to discuss this with either Travis Wiggs or Seth Ascher, the two Commission counsel who are currently handling periodic review. I've copied them here so you have their contact information.
