Hello Mr. Ascher,

Thank you again for the opportunity to consult concerning the readoption date and timeline for these rules. The agency would like to respectfully request a readoption date for applicable rules in 10A NCAC 09 of September 2029 based on the attached draft timeline. Considerations/priorities informing this requested timeline and order

of planned work for the Child Care Commission’s readoption of rules deemed necessary as part of the Periodic Review of Rules include:

  • Minimizing the need to require multiple reviews by placing rule sections informed/referencing/impacted by other sections at the end of the working timeline
  • Categorizing rules in alignment with additional priorities identified by the Commission and community/stakeholder input during the Quality Rating Improvement System (QRIS) Modernization rulemaking mandated by NC General Assembly Session Laws and recently effective July 1, 2025 as well as with recently filed rulemaking petitions and recently enacted Session Law which may inform the Commission’s rulemaking decisions
  • Expectation of additional review, discussion, and decision-making space and time for rules specific to Family Child Care Homes in 10A NCAC 09 .1700 (slated for end of review timeline due to other rules concerning child care centers informing rules for family child care homes) based on additional questions and discussion during the QRIS Modernization rulemaking process; the Commission wishes to ensure adequate space and time to address all questions, concerns, and potential challenges and barriers identified effectively.
  • Utilizing the Commission’s existing quarterly meeting schedule to maximum efficiency and effectiveness; the agency wishes to make the best use of resources and time for the 17-member Commission with special Commission meetings to be determined and scheduled as needed to ensure timely, effective, and thorough completion

The attached periodic review reports have been finalized. The next step is to set a deadline for the readoption of these rules. Pursuant to G.S. 150B-21.3A and 26 NCAC 05 .0212, the RRC sets this deadline after consultation with the agency, and this email serves as the RRC’s request for that consultation. Please review 26 NCAC 05 .0212 for the information required to be submitted to the RRC, and the deadlines for doing so.

It appears that the deadline for your agency to provide this information is October 14, 2025. As a starting point, I would recommend a October 1, 2028 readoption deadline, but I am open to considering a different recommendation based on the needs of your agency.
